A m\u00e9s, en la via civil, l&#8217;estrat\u00e8gia i la documentaci\u00f3 s\u00f3n determinants: contracte, justificants, comunicacions i tra\u00e7abilitat dels pagaments.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Un impagament puntual \u00e9s el mateix que morositat sostinguda?<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Retr\u00e0s puntual<\/strong>: pot resoldre&#8217;s amb una comunicaci\u00f3 clara i una data de regularitzaci\u00f3.<\/li>\n\n\n\n<li><strong>Morositat sostinguda<\/strong>: quan l&#8217;impagament <strong>es repeteix<\/strong> o el llogater <strong>deixa de pagar<\/strong> i no proposa una soluci\u00f3 realista, sol activar-se la via de reclamaci\u00f3 i, si escau, el desnonament per manca de pagament.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Primers passos recomanables quan apareix un impagament de lloguer<\/strong><\/h2>\n\n\n\n<p>Aquests passos s\u00f3n \u00fatils tant per a particulars com per a empreses amb cartera d&#8217;immobles:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Revisi\u00f3 del contracte i de la situaci\u00f3 de pagaments<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Data exacta de venciment de la renda.<\/li>\n\n\n\n<li>Imports deguts i conceptes (renda, subministraments, despeses pactades).<\/li>\n\n\n\n<li>Fian\u00e7a i garanties addicionals pactades (si existeixen).<\/li>\n\n\n\n<li>Si hi ha avalista\/fiador i com se li pot reclamar.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Comunicaci\u00f3 fefaent: per qu\u00e8 importa<\/strong><\/h3>\n\n\n\n<p>Molts propietaris opten per reclamar de forma fefaent (per exemple, burofax) deixant const\u00e0ncia de:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Quines quantitats estan impagades.<\/li>\n\n\n\n<li>Termini per regularitzar.<\/li>\n\n\n\n<li>Conseq\u00fc\u00e8ncia si no es paga (accions legals).<\/li>\n<\/ul>\n\n\n\n<p>Aix\u00f2 cobra import\u00e0ncia perqu\u00e8 la llei contempla l&#8217;<strong>enervaci\u00f3 del desnonament<\/strong> (pagament per frenar el procediment) i fixa sup\u00f2sits en els quals aquesta enervaci\u00f3 no escau si l&#8217;arrendador va requerir el pagament amb <strong>almenys 30 dies abans<\/strong> de demandar i, aix\u00ed i tot, no es va pagar.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Quines opcions legals existeixen davant un impagament de lloguer a Espanya<\/strong><\/h2>\n\n\n\n<p>Quan parlem d&#8217;<strong>impagament de lloguer<\/strong>, la via habitual \u00e9s la civil:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Reclamaci\u00f3 de quantitats<\/strong> (cobrament del que es deu).<\/li>\n\n\n\n<li><strong>Desnonament per manca de pagament<\/strong> (recuperar la possessi\u00f3), acumulant o no la reclamaci\u00f3 de rendes.<\/li>\n<\/ol>\n\n\n\n<p>En el procediment de desnonament per impagament, despr\u00e9s d&#8217;admetre la demanda, el jutjat requereix el demandat perqu\u00e8, <strong>en 10 dies, desallotgi, pagui o formuli oposici\u00f3<\/strong>; i tamb\u00e9 es contemplen les condicions d&#8217;enervaci\u00f3.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>L&#8217;enervaci\u00f3 del desnonament: qu\u00e8 \u00e9s i quan es permet<\/strong><\/h3>\n\n\n\n<p>L&#8217;enervaci\u00f3 \u00e9s la possibilitat que el llogater <strong>pagui el deute dins del termini del requeriment i el proc\u00e9s acabi<\/strong>, mantenint-se el contracte.<\/p>\n\n\n\n<p>La <a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-2000-323\"><strong>Llei d&#8217;Enjudiciament Civil<\/strong><\/a> regula aquest cas i marca l\u00edmits clars:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>No s&#8217;aplica si l&#8217;arrendatari ja va enervar una vegada abans (amb matisos).<\/li>\n\n\n\n<li>No s&#8217;aplica si l&#8217;arrendador va reclamar el pagament per mitj\u00e0 fefaent amb almenys 30 dies d&#8217;antelaci\u00f3 a la demanda i no es va pagar en presentar-la.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Quant de temps pot estar un llogater sense pagar el lloguer?<\/strong><\/h2>\n\n\n\n<p>No existeix un &#8220;dret&#8221; del llogater a estar certa quantitat de mesos sense pagar. Tan bon punt hi ha una mensualitat ven\u00e7uda i impagada, estem davant un <strong>impagament de lloguer<\/strong> i el propietari pot valorar accions.<\/p>\n\n\n\n<p>El que s\u00ed que passa en la realitat \u00e9s que, per prud\u00e8ncia o per intentar evitar conflicte, alguns arrendadors esperen uns dies o una segona mensualitat per confirmar que no \u00e9s un retr\u00e0s puntual. Aquesta decisi\u00f3 dep\u00e8n del cas (perfil del llogater, historial, comunicaci\u00f3, quantia, depend\u00e8ncia d&#8217;aquest ingr\u00e9s, etc.).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Quant es triga a fer fora un llogater per impagament?<\/strong><\/h2>\n\n\n\n<p><strong>No hi ha un termini \u00fanic.<\/strong> El que s\u00ed que es pot explicar amb claredat s\u00f3n els punts del cam\u00ed que solen marcar el ritme:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Fites del procediment que influeixen en el temps total<\/strong><\/h3>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Requeriment i termini de 10 dies<\/strong><\/h4>\n\n\n\n<p>Despr\u00e9s de l&#8217;<strong>admissi\u00f3<\/strong> de la demanda, el requeriment concedeix al demandat <strong>10 dies<\/strong> per pagar, desallotjar o formular oposici\u00f3.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Assenyalament de vista i llan\u00e7ament<\/strong><\/h4>\n\n\n\n<p>El mateix requeriment pot incloure:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Dia i hora per a una eventual vista (si hi ha oposici\u00f3).<\/li>\n\n\n\n<li>Dia i hora per al llan\u00e7ament (si no hi ha oposici\u00f3), sense necessitat de notificaci\u00f3 posterior en certs sup\u00f2sits.<\/li>\n<\/ul>\n\n\n\n<p>Si hi ha oposici\u00f3, el procediment passa per vista i resoluci\u00f3. A m\u00e9s, en determinades resolucions es fixa data de llan\u00e7ament i es contempla que hagi de verificar-se <strong>abans de 30 dies<\/strong> des de la data assenyalada per a la vista (segons l&#8217;encaix processal del cas).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Per qu\u00e8 el temps real pot variar tant<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>C\u00e0rrega de treball del jutjat.<\/li>\n\n\n\n<li>Dificultat per notificar i practicar actes de comunicaci\u00f3.<\/li>\n\n\n\n<li>Si existeix oposici\u00f3 i qu\u00e8 es discuteix.<\/li>\n\n\n\n<li>Si hi ha enervaci\u00f3 o acords a mig del proc\u00e9s.<\/li>\n<\/ul>\n\n\n\n<p>\u00c9s a dir, l&#8217;<strong>impagament de lloguer<\/strong> pot resoldre&#8217;s relativament r\u00e0pid si no hi ha oposici\u00f3 i les notificacions funcionen, per\u00f2 pot allargar-se si es complica qualsevol dels punts anteriors.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Quan es pot denunciar per impagament de lloguer?<\/strong><\/h2>\n\n\n\n<p>En la majoria de casos, l&#8217;<strong>impagament de lloguer<\/strong> no es tramita com a den\u00fancia penal, sin\u00f3 com a <strong>conflicte civil<\/strong> derivat d&#8217;un contracte.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Llavors, quan entra el que \u00e9s penal?<\/strong><\/h3>\n\n\n\n<p>Hi ha escenaris excepcionals en els quals es podria parlar de <strong>delicte<\/strong>, normalment lligats a engany inicial (per exemple, si s&#8217;acredita que es va signar amb intenci\u00f3 de no pagar des de l&#8217;inici). Tot i aix\u00ed, s\u00f3n situacions que requereixen an\u00e0lisi jur\u00eddica i prova s\u00f2lida.<\/p>\n\n\n\n<p>Per a l&#8217;enorme majoria de propietaris, el que desbloqueja la situaci\u00f3 \u00e9s la via civil: <strong>desnonament per manca de pagament i reclamaci\u00f3 de quantitats<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Com reduir l&#8217;impacte econ\u00f2mic de l&#8217;impagament de lloguer amb assegurances<\/strong><\/h2>\n\n\n\n<p>Quan l&#8217;objectiu \u00e9s protegir ingressos, una part del problema de l&#8217;<strong>impagament de lloguer<\/strong> no \u00e9s jur\u00eddica: \u00e9s financera.
